What is a contract of employment?

A contract of employment is a legally binding agreement between employer and employee. It is important that employers make the relationship clear from the outset, not least because employees have more rights in law than non-employees. Some information must be included in one document and other information can be delivered in instalments.

The essential items usually included in the main document:

  • names of employer and employee
  • date of which employment began
  • date on which employee's continuous employment began
  • rate of remuneration
  • intervals at which remuneration is paid, that is, weekly, monthly or other.
  • holiday entitlement and holiday pay
  • job title
  • place of work

examples of items that may be included in instalments:

  • terms and conditions relating to sickness or injury, including provisions for sick pay
  • terms and conditions related to pensions
  • notice period
  • collective agreements
